The main objective of the article is to analyze some of the legislative texts that encouraged the expansion of for-profit private higher education in Brazil, since the Federal Constitution of 1988, until the middle of 2010. The textual analysis was made through the qualitative approach, with the selection of books, academic theses, articles published in journals, the legislation relevant to the discussion, and some statistical data. Thus, it was possible to observe the remarkable growth of the Private Profitable Higher Education Institutions, in a short time, mainly through the strong role of the State and the Public Fund.
