⠀ Objective good faith as a general clause and the assumptions for its application

Objective good faith because adopted in the Civil Code as a general clause, is understood in a multifaceted way, operating with several functions in the Brazilian legal system. If, on the one hand, the changes in the Civil Code have provided greater dialogue with other contractual principles, such as the conservation of legal businesses, and have given the legal system an opening for ethical conduct requirements, on the other hand, the indeterminacy of the general clause relating to good faith led to a general understanding of the concept, giving rise to its indiscriminate use, without its dif-ferent meanings, ethical, economic, interpretative and establishing duties to the parties, even in the pre and post contractual phases. As a result, knowledge and determination of the different meanings assumed by objective good faith becomes necessary, through the adoption of application assumptions that guide the lawyer in the good use of the general clause in the resolution of the specific case.
