⠀ Objective good faith as a general clause and the assumptions for its application

Abstract

Objective good faith because adopted in the Civil Code as a general clause, is understood in a multifaceted way, operating with several functions in the Brazilian legal system. If, on the one hand, the changes in the Civil Code have provided greater dialogue with other contractual principles, such as the conservation of legal businesses, and have given the legal system an opening for ethical conduct requirements, on the other hand, the indeterminacy of the general clause relating to good faith led to a general understanding of the concept, giving rise to its indiscriminate use, without its dif-ferent meanings, ethical, economic, interpretative and establishing duties to the parties, even in the pre and post contractual phases. As a result, knowledge and determination of the different meanings assumed by objective good faith becomes necessary, through the adoption of application assumptions that guide the lawyer in the good use of the general clause in the resolution of the specific case.

Graduado em direito pela Universidade de São Paulo (2001), doutorado em direito pela Ludwig-Maximilians-Universität München (2007) e livre-docente em direito romano pela Universidade de São Paulo (2008). Foi Professor Assistente junto ao Leopold-Wenger-Institut da Ludwig-Maximilians-Universität München. Atualmente é Professor Associado da Faculdade de Direito de Ribeirão Preto da Universidade de São Paulo. Tem experiência na área de Direito, com ênfase em Direito Privado, Direito Romano, Direito Civil, História do Direito e Direito Comparado (Direito alemão).
