Abstract

It is known that Constitutional Law hasadvanced with some caution regarding the treatmentof such issues as the effectiveness of constitutional rulesconcerning about fundamental rights, especially thoserelated to the rights which demands positive benefits.These are rights or guarantees that often require positiveactions by the governmental organisms, able to supplyfundamental materials needs, such as life itself and themaintenance of a basic dignity standard. In the face ofbudget impossibilities, rectius, the scarcity of publicresources for such purposes, the German case lawinnovated with the reserve of possible (Vorbehalt desMöglichen), which is a sort of restriction on the fullapplicability of fundamental rights based on economicand financial criteria. This study will focus on its originsand the ways of implementing the reserve.

Possui graduação em Direito pela Universidade Estadual de Londrina (UEL), mestrado em Direito do Estado pelaUniversidade Estadual Paulista Júlio Mesquita Filho (UNESP), doutorado em Direito Constitucional pela PontifíciaUniversidade Católica de São Paulo (PUC-SP) e doutorado em Ciências Jurídicas e Sociais pela Universidade doMuseu Social Argentino. Juiz de Direito em Goiás, professor-adjunto da Universidade Católica de Goiás (UCG) e doInstituto de Ensino e Pesquisa Científica (IEPC-Goiânia).
