THE PROTECTION OF THE RIGHTS OF DOMESTIC ANIMALS IN SPAIN: A BRIEF STUDY ON THE NEW LAW 17/2021, OF DECEMBER 15, AMENDING THE CIVIL CODE, THE MORTGAGE LAW AND THE LAW OF CIVIL PROCEDURE ON THE LEGAL REGIME OF ANIMALS

Abstract

As of this 21st century, both in the Spanish Penal Code, as well as at the end of this year two thousand and twenty-one, the Spanish legislator enacted a law that protects animals, specifically domestic animals, since during the summer period many of the owners who bought pets, abandon them to their fate. Therefore, this article aims to carry out a legal-descriptive analysis of the new law that protects domestic animals in Spain. Therefore, one of the important objectives is that couples, whether de facto or married, separate or want to separate and one of the ex-partners tries or mistreats their pets to harm the other ex-partner. Even this ex-partner who owns the pet animal reaches the point that she is afraid of divorcing or separating because of the damage or alleged damage that she could do to her pet, since it harms the owner of the animal both morally and, as well as psychologically.
