The purpose of this study is to analyze the character of the dignity of the human person, with the aim of assessing whether this is a relative fundamental right and can be subjected to the proportionality test or constitutes an absolute right and, therefore, cannot be considered with others rights that may conflict with it, disallowing restrictions. To this effect, the present work begins addressing the concept of the dignity of the person and its main characteristics. Subsequently, the proportionality test is presented as the main methodological tool for solving collisions between fundamental rights. Lastly, this study seeks to respond to its central questioning of work, specifying the character of human dignity in the constitutional legal order. For that, the deductive methodology and bibliographic research techniques were adopted. In this way, it is observed that the dignity of the human person has a dual nature, of rule and principle, consubstantiating a relative fundamental right that is not immune to some limitations, but has an essential nucleus, whose scope will be determined from the application of the test proportionality.
