INHERITANCE IN PROFESSOR SHELLY KREICZER-LEVY’S THOUGHT

Abstract

In this paper, I studied Professor Shelly Kreiczer-Levy’s theory on inheritance. I conducted a review of her scholarship, followed by the description of her thought’s main concepts. I aimed to spread an innovative theory on Inheritance Law. I observed that Professor Kreiczer-Levy understands inheritance as an institution which promotes continuity between the giver and the recipient through the posthumous transfer of property. I noticed that an intergenerational bond is created between the different subjects of a succession. I figured out that both parties are necessary to the success of the continuity project; they both have relevant, complementary interests in inheritance. For that reason, succession is a bifocal, relational institution. I concluded that both giver and recipient must be taken into consideration both by inheritance scholarship and legislation; thus, it is inadequate to deal with inheritance focusing only one of them. Lastly, I saw practical applications of Professor Kreiczer-Levy’s theory.
