Memory and interpretation: the law of “clean record” in face of the principles of the proportionality and of the reasonableness

In this paper, we present results of research, which had as objective analyze interpretations proposed by hermeneuts in the STF, when this tribunal, exercising the concentrated control of constitutionality of the LC 135/2010, assessed the validity of the said law, for alleged affront to the Principle of the Proportionality/Reasonableness. To this end, we examined the ADC’s 29 and 30 and the ADI 4.578, mobilizing theoretical postulates of the Discourse Analysis. At the end of the trial of these actions, the STF came to the conclusion that the LC 135/2010 not violated the Principle of the Proportionality/Reasonableness.
