RESUMO:

O presente artigo analisa dois componentes dos contratos agrários típicos brasileiros: a limitação do preço e a forma de pagamento. A indagação que permeia o estudo é se a intervenção do estado, limitando a autonomia das partes, ainda se justifica no panorama jurídico-econômico atual. O estudo está dividido da seguinte forma: uma análise geral que verifica a importância dos contratos agrários; estabelece a diferença de natureza jurídica do contrato de arrendamento e parceria; e aponta as diferenças entre preço e pagamento. Posteriormente, o tema central do artigo é a análise do preço e pagamento no contrato de arrendamento. Depois, o mesmo estudo se repete para o contrato de parceria. Encerra-se com as considerações finais e referências bibliográficas.

ABSTRACT:

This paper analyzes two components of typical Brazilian agrarian contracts: price limitation and method of payment. The research question is if the state interventionism that limits private autonomy is still justified in the current legal and economic landscape. The paper is divided as follows: a general analysis about the importance of agrarian contracts, the difference in the legal nature of rural tenancy and rural partnership, and the differences between price and payment. Then, the central theme of the article is the analysis of price and payment on rural tenancy, and in the next section a similar analysis is done about rural partnership. The paper closes with conclusions and references.
