Democratic Renewal of Law Trought to Popular Participation in the “Theory of the Juridical Principles”

Abstract

The article shows that the organic developmentof the World society is ambiguous and that the relationsmaintaining in the man’s world, in the History, in theScience and in the Law, they are environmentally tangledat the previous positions adopted to proceed the stabilizationof the life’s contexts and to mitigate the contingenceof the inexplicable. Actually, it’s perceptible that the conflictbetween the two paradigms of regulation and socialdevelopment; that are: the “liberal-monetary system” andthe “estate system”; disestablished the popular confidenceat the bourgeois’ democracy whose legitimate always wascontradictory at the practice; because it doesn’t foreseeinstitutional forms to absorb the other’s true. Looking foroptimism to analyse the matter is possible to suggest, withbase on stud of a uncial case to use structurally the “theoryof the juridical principles” like a “locus” to the greaterapproximation between the democratic overcoming of thebourgeois social theory and the inter-dogmatically compatibilityof the law’s kinds principals that having autonomousprinciples surrounding at the world society.
