Abstract

The proposal of the study is to demonstratethat the access to the judgement, right of the citizen inthe democratic State of right, is inexorably, half efficientof promotion of ambient justice in the agrarian way. This,in turn, is closely on question to social justice and it isonly feasible through the fulfilment of the social functionof the agricultural property. For such necessity it ispresented reorganization of the judiciary organization, insome States and the federal sphere, made possible for thedisposal of art.126 and its only paragraph of the FederalConstitution that foresees the creation of the specializedAgrarian Poles and itinerantes Agrarian Courts.
