Abstract

Thanks to a large evolution, it was created,in modern bankruptcy law, an environment which encouragesthe safeguarding of the company through theinstitutionalization of the so celebrated new ideologyof its preservartion. This ideologism appears becauseof the significant social role of the company, most importantinstitution of contemporary world, in nationaleconomy, with highlights on the micro and small companies,which together represent the incontestable mostproductive units in the country. The importance of suchcompanies is incontestable, in the way that they enjoy adifferent treatment, which includes a special plan for recovery,much more simplified and less expensive, able toanswer their peculiarities. It happens that with the currentinternational economic and financial crisis, whoseeffects in Brazil are not kept unscathed, small businesseswere severely impacted, mainly because of the retractionof credit. Thus, is importat to pay special attention to thisbusiness segment at this time of crisis, with emphasis onadoption of public policies that minimize the impacts ofthe crisis on it, to its preservation.
