discourse of Forget bound to The institution of amnesty: Concepts of discursive Theory of law and democracy

Abstract

Is work aims to demonstrate that thereis a discourse of forget bound to the institution ofamnesty, following the analysis of procedures involvedwith in legislative issues of amnesty in Brazil. Conceptsof Law Integrity of Ronald Dworkin, and the Discursiveeory of Law and Democracy of Jurgen Habermaswere used in this analysis. It was considered the discoursedeviations and the meanless arguments that amalgamatesthe idea of forget of facts occurred during theauthoritarian Brazilian regime of 1964-1985 linked toamnesty. Considering the State of Democracy and Law,it was veried the need t o unlink amnesty from the ideaof impunity, observing the international principles ofhuman rights, adopting compatible attitudes regardingthe lack of fundamental rights, and the construction of asocial memory about the totalitarian regime time.
