Abstract

The article's object of study is the right to information that enables the public and civil society to access information held by public bodies, its relevance to the Democratic Rule of Law and the need for its protection, notably in periods of uncertainty, such as the public health emergency of international importance resulting from the coronavirus that plagues the world and Brazil. It uses the deductive method and, through a methodological path, the case study of Medida Provisória 928/2020 and its judgment by the Supreme Federal Court, to conclude on the necessary attention that must be given to the constitutional, instrumental and legal aspects of the right of access to information, even more at times like those currently experienced
