APPLICATION OF ARTICLE 97 OF THE FEDERAL CONSTITUTION IN ARBITRATION

The purpose of this article is to analyze whether the article 97 of the Federal Constitution should be applied, the so-called full bench clause, in the resolution’s of conflicts by arbitration regarding the absence of specific work on the subject. Using the deductive method, the study approaches arbitration, the autonomy of the parties' free will in their format, constitutionality control and the full bench clause, concluding that an arbitral award will always be rendered by the absolute majority and, in the event of a tie, a decision will be made by the president, reaching the absolute majority, since the number of arbitrators is always odd, applying a plenary reservation clause.
