Résumé

RESUMO:

O artigo objetiva examinar alguns aspectos conceituais da concepção contemporânea dos direitos humanos que se afirmou no período após a Segunda Guerra Mundial e, em seguida, problematizar os principais desafios e entraves para sua implementação. Neste sentido, pretende analisar em que medida tais obstáculos - a ocidentalização dos direitos humanos; a universalidade dos direitos humanos frente ao relativismo cultural; a indivisibilidade dos direitos humanos frente ao processo de globalização econômica; a proteção dos direitos humanos, princípio da não-ingerência e flexibilização da soberania Estatal; e  a proteção dos direitos humanos e a ausência do poder de coerção - podem significar um processo de desconstrução do direito internacional dos direitos humanos.

ABSTRACT:

The article aims to examine some conceptual aspects of contemporary conception of human rights as stated in the period following World War II and then discuss the key challenges and bias to its implementation. In this sense, aims to analyze to what extent these obstacles – Western conception of human rights; universal human rights versus cultural relativism; the indivisibility of human rights versus the process of economic globalization; the protection of human rights before the principle of non-interference and flexibility of State sovereignty; and the protection of human rights before the absence of coercive power - can signify a process of deconstruction of international human rights law.
