FREEDOM IN THE 21ST CENTURY: A REFLECTION FROM THE ISSUE OF EDUCATION PROVIDED AT HOME

The object of the article is the idea of Freedom in the 21st century. The general objective was to identify the line adopted by the Supreme Court in relation to Freedom, when the Extraordinary Appeal (RE) 888.815/ RS was judged. As a research problem: Given the social transformations and conflicts of interpretation and application of the norm, how to interpret Freedom in the current legal order? The article presents a first moment with the evolution of thinking about the idea of ??freedom. A second that discusses the idea of ??freedom as equality of opportunity and the third that deals with the most appropriate decision by the Supreme Court to respond to society's demands and wishes. The Supreme Court decided by majority on the idea of ??Freedom as Equal Opportunity, centered on enabling everyone, regardless of social or economic status, to have access to tools that enable them to match the opportunities of others. Although the issue of the quality of education is not the focus of the discussion, the STF's decision indirectly makes all citizens responsible for the quality of education for all people, not just their children. With the bills in the National Congress, this reality may change soon. The inductive method was used with the bibliographic research.
