Abstract

The right of preemption is an instrument that has the potential to enable the realization of housing programs of social interest, and to avoid the process of gentrification in areas that suffer real estate appreciation. It can also be used as a means of recovering real estate gains, enabling redistributive policies to mitigate socio-spatial inequality. In response to the situation of injustice arising from the neoliberal city context of unequal urban land grabbing, France has stood out for its social housing programs that are aimed at people who cannot afford it, as is the case. of preemption right - which can be used as a reference for Brazilian law. The methodology adopted was the analysis of the laws of France and Paris, complemented by bibliographic research on the subject.
