Delimitation of the PPAs of artificial lakes resulting from multi-purpose water dams

Abstract

Permanent Preservation Areas (PPAs) of artificial reservoirs and natural reserves have the function of preserving water resources, landscape, geological stability, and biodiversity. Moreover, the maintenance of these areas can prevent their disordered uses from causing damage to the dams, which would have affected their safety. According to the Forest Code (Federal Law No. 12,651/2012), a PPA strip should be defined during the environmental licensing of each dam. However, the general rules governing this delimitation, established by the Forest Code and CONAMA Resolution No. 302/2002, present some discrepancies, which may bring subjectivity in interpretation and generate legal uncertainty. Therefore, this study was performed to survey the state regulations that establish more objective criteria for the delimitation of PPAs of artificial reservoirs. As per available data only six states have regulations that address this issue, and the application of most of them may give rise to legal disputes, because they go against the dictates of federal regulations.
