Abstract

Considering the territory as a key element in identity construction, this proposed study of the issues pertaining to indigenous territorial element used as a critical analysis of
legal parameters concerning the brazilian indigenous issue, since the principles of the formation of the National State, have been marked by continuous reproduction of power relations that still breed in the contemporary historical conjuncture, posing problems of socio-political-space that block meaningful dialogue and conviviality balanced between different cultural groups that make up the ethnic diversity of Brazil. The projection of the current challenges living for the brazilian indigenous serves as verification the numerous contradictions involving the indigenous laws. Through an interdisciplinary
perspective, we aimed to understand the ethnic relations that make up the patchwork of brazilian society.
