POLITICAL JUDGMENT, IDEOLOGY AND UTOPIA: ELEMENTS FOR THE CONSTRUCTION OF A LEGAL IMAGINARY

O presente artigo apresenta uma forma específica de imaginário, o jurídico, através dos conceitos de juízo político e ideologia tal como encontrados nas filosofias de Hannah Arendt e Paul Ricoeur. Ele se inicia com um sucinto esclarecimento do juízo político em Arendt e da relação entre ideologia e utopia na reflexão de Ricoeur acerca do justo. Adotando como metodologia uma revisão de literatura cujo fio condutor são esses três conceitos, esta pesquisa apresenta uma concepção de imaginário jurídico que se encontra enraizada nas práticas jurídicas cotidianas, dotando-as de significado, mas também apresentando uma radicalidade normativa que transcende os valores e os referenciais já atualizados na esfera jurídica. O artigo conclui que o imaginário jurídico remete a uma projeção coletiva sobre relações sociais e arranjos políticos considerados mais desejáveis, fazendo dessa concepção de imaginário um conceito político essencialmente contestável: cada grupo projeta nesse imaginário os seus valores, anseios e convicções, interpretando e operacionalizando as normas jurídicas a partir desses referenciais.
