Fundamentals of the Human Right to Memory in Global Constitutionalism

The work aims to analyze Human Rights in the face of Global Constitutionalism, in order to do a critical debate on the two characteristics of Human Rights, historicity and universality, to achieve a human right of memory that can be related with the Global Constitutionalism of Bartolomé Clavero. The problem of this reflection is to try to demonstrate the existence of this human right and its link with the human dignity, and its nonrestriction to a particular people. To do that, we review the literature on the issue and an analyze a Brazilian case. The conclusion will be a balance of the debates and on the solutions of the presented proposals.
